Terms of Service & End User License Agreement

1. Acceptance of Terms & Legally Binding Agreement

By inviting the Bot to a server, interacting with slash or prefix commands, accessing ticket channels, uploading schematic files, purchasing subscriptions/roles, or participating in the community (collectively, the “Services”), you (“User”, “Client”, or “You”) enter into a legally binding contract with DonutSMP Schematics & Building.

If you do not agree to every provision of these Terms without modification, you are strictly prohibited from using the Bot and Services and must immediately disconnect and cease all interaction.

3. Scope of Services & Independent Contractor Status

1. Automated Utilities: Services include 3D schematic rendering (.litematica, .schem, .schematic), block parsing, material calculation, economy minigames, advertising management, and ticket automation.
2. Independent Status of Builders: Any builders, designers, or community staff operating within ticket channels act strictly as independent community participants and NOT as employees, legal partners, or agents of the Bot owners/developers. We bear zero liability for independent actions, agreements, or disputes between individual users and builders.
3. Ticket Logging & Transcript Records: All commission tickets and support inquiries are automatically archived with timestamped records. In the event of a commercial dispute or allegation of non-delivery, these transcripts shall serve as conclusive evidence of interactions and mutual agreements.

4. User Representations, Warranties & Acceptable Use

By using the Services, you warrant and represent that:

1. You are at least 13 years of age (or the legal age of majority in your jurisdiction). If you are between the ages of 13 and 18, you represent that you have obtained explicit parental or legal guardian consent to use the Bot and conduct any voluntary transactions.
2. You will NOT upload corrupted files, malicious scripts, zip bombs, unauthorized software, or schematics designed to crash servers or exploit packet structures.
3. You will NOT reverse engineer, decompile, scrape, automate unauthorized requests, bypass rate limits, or launch denial-of-service (DoS/DDoS) attacks against the Bot, its web dashboard, or hosting infrastructure.
4. You will NOT use alternate accounts to circumvent bans, moderation strikes, ticket restrictions, or economy balance caps.
5. You possess all necessary rights, licenses, and permissions for any schematic files, builds, or assets you submit.

6. Intellectual Property & License Grant

1. Your Content: You retain ownership of original Minecraft builds and schematics you create.
2. License to the Service: By submitting files through the Bot, you grant us an irrevocable, perpetual, worldwide, royalty-free, transferable license to store, parse, analyze, generate 3D preview renders of, and display your submitted content solely for executing requested bot operations.
3. DMCA / Takedowns: If you believe content processed by the Bot infringes your copyright, submit a formal takedown request with proof of ownership through our official Discord support ticket system.

7. Absolute Disclaimer of Warranties (“AS IS” and “WITH ALL FAULTS”)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BOT, SERVICES, WEB DASHBOARD, SCHEMATIC RENDERS, AND ALL ASSOCIATED OUTPUTS ARE PROVIDED EXCLUSIVELY ON AN “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS” BASIS.

THE DEVELOPERS, OWNERS, OPERATORS, AND AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE QUALITY, TITLE, AND NON-INFRINGEMENT;
• ANY WARRANTY THAT THE BOT WILL BE UNINTERRUPTED, BUG-FREE, SECURE, ACCURATE, TIMELY, OR FREE FROM HARMFUL CODE OR ERRORS;
• ANY WARRANTY REGARDING THE ACCURACY OF SCHEMATIC BLOCK COUNTS, DIMENSION PARSING, OR COMPATIBILITY WITH SPECIFIC MINECRAFT VERSIONS OR MODS.

8. Complete Limitation of Monetary & Consequential Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES SHALL DONUTSMP SCHEMATICS & BUILDING, ITS CREATORS, DEVELOPERS, ADMINISTRATORS, OR AFFILIATES BE LIABLE FOR ANY:

1. INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
2. LOSS OF PROFITS, REVENUE, DATA, SCHEMATICS, GOODWILL, OR BUSINESS OPPORTUNITIES;
3. IN-GAME LOSSES, INCLUDING BUT NOT LIMITED TO MINECRAFT SERVER BANS, SERVER ROLLBACKS, IN-GAME ITEM LOSSES, LOSS OF CURRENCY, GRIEFING, OR RAIDING;
4. HARDWARE DAMAGE, DATA CORRUPTION, OR SERVICE INTERRUPTIONS RESULTING FROM DISCORD API FAILURES, SERVER CRASHES, OR NETWORK DOWNTIME.

9. Full Indemnification (Hold Harmless)

You agree to fully defend, indemnify, and hold harmless DonutSMP Schematics & Building, its lead developers, operators, server administrators, builders, and affiliates from and against ANY and ALL claims, liabilities, lawsuits, demands, damages, losses, settlements, judgments, penalties, fines, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or directly/indirectly related to:

1. Your use, misuse, or inability to use the Bot or Services;
2. Any schematic, file, text, or content you submit or transmit;
3. Your violation of any provision of these Terms;
4. Your violation of any third-party rights, including intellectual property, copyright, or privacy rights;
5. Any dispute, agreement, or interaction between you and another user or builder.

YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE USE OF THE BOT, SERVICES, OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE, OR BE FOREVER TIME-BARRED.

12. Account Termination, Blacklisting & Modification Rights

1. Right to Terminate: We reserve the unilateral right to suspend, terminate, restrict, or blacklist your access to the Bot, all ticket systems, and affiliated servers at any time, for any reason, with or without prior notice, and with zero liability.
2. Right to Modify Terms: We reserve the right to revise or update these Terms at our sole discretion. Continued interaction with the Bot following the posting of updated terms constitutes binding acceptance of the revisions.

13. Severability & Entire Agreement

• Severability: If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable, that specific provision shall be limited or eliminated to the minimum extent necessary, and all remaining provisions shall continue in full force and effect.
• Entire Agreement: These Terms, together with our Discord Privacy Policy, constitute the entire and exclusive agreement between you and DonutSMP Schematics & Building regarding the Services.
